They also injured Richard Keogh, out for a year, not great for a 33 year old

That's about right for drink driving, they were both drink driving and crashed into each other remember.

Yes, they drove off but they both returned on there own accord.  Who knows how you would first react in that situation..

Very rarely do people go to jail for first time driving offences.

Actually, I think this is entirely consistent with my experience of recently sitting in a Magistrate courtroom and observing similar cases. As others have said, there are many factors taken into consideration and I can see why custody was an option, but not the one taken on this occasion. Having taken a couple of days in recent months to observe many cases in a Magistrates court, I've really gained an improved view on how they apply the law...and believe me, I'm fully in favour of justice being done with custody when appropriate.
