Let's hope so , you'd imagine after two years and the fact he's appearing at Crown court the CPS have a pretty solid case .

He has always been a muppet. First thing I remember him doing was the cigar incident. Don't all get angry with me, He was a good player. Who shall we say ? Had tactics. He is no role model to be a manager though.

His direct opponent high tails out of the stadium and in to a waiting car driven by his chairman .

Said car is stopped by a police officer before it can get out of the car park .

A man is then interviewed by police and is subsequently charged .

Said man has a previous conviction for violence and served a custodial sentence .

Those are the facts and they are undisputed .

They may be undisputed on here, but until he has been to court and been found guilty by the courts he is, and always will be innocent. No matter how much gum bumping and keyboard warrior’ing goes on on here and other forums he is innocent until found guilty.

Sadly, those with the most money tend to be able to get someone to find a loophole to exploit a technicality and remain "innocent".
I really hope justice is done this time but even if found guilty I wouldn't be surprised to see a community sentence.

That link's very informative, and puts a somewhat different slant on the matter; because I, and a lot of other people I would imagine, was under the impression that Barton headbutted Stendel.

If he's got a good lawyer, I can see Barton getting off here.

I'm not sure a fine would be an option. The case is in court to determine, beyond reasonable doubt, whether Barton assaulted Stendel. If he's found guilty, he's found guilty of the assault (and he does have form), if there's doubt in there, then he's found not guilty.

Personally, I think that even if Barton committed the assault, he is rich enough to pay for a defence lawyer good enough to sow the seeds of doubt against the evidence presented, most of which appears to be circumstantial.

It depends on whether there is any CCTV evidence.  There was a report saying the tunnel cameras may have caught the incident.  If he caused harm to Stendel and it is proven, then it could be one of the following....

There are three basis types of assault offence:

common assault
actual bodily harm (ABH)
grievous bodily harm (GBH)/ wounding


Common assault is when a person inflicts violence on someone else or makes them think they are going to be attacked. It does not have to involve physical violence. Threatening words or a raised fist is enough for the crime to have been committed provided the victim thinks that they are about to be attacked. Spitting at someone is another example.

Actual bodily harm (ABH) means the assault has caused some hurt or injury to the victim. Physical injury does not need to be serious or permanent but must be more than “trifling” or “transient”, which means it must at least cause minor injuries or pain or discomfort. Psychological harm can also be covered by this offence, but this must be more than just fear or anxiety.

Grievous bodily harm (GBH) means the assault has caused serious physical harm. It does not have to be permanent or dangerous. For example, a broken bone would amount to GBH – in some cases a broken bone might lead to permanent disability but, in others, it might heal without leaving any long-term effects. GBH can also include psychiatric injury or someone passing on an infection, for example through sexual activity.

Wounding requires that the victim’s skin is broken, either on their body or their inner skin (for example, inside their lip) but it does not include the rupture of blood vessels so, if the injury is just bruising, that would not amount to wounding. The injuries involved in a wounding can be less serious than those in GBH.

The GBH or wounding must be caused either with an intent to cause some injury or with knowledge that injury was likely. If it was committed with intent to cause GBH or wounding then the offence is more serious. The maximum sentence for this is life imprisonment.

The offence is also more serious if the victim of the assault is an emergency worker. This covers police, prison officers, custody officers, fire service personnel, search and rescue services and paramedics.

Sentencing

Parliament sets the maximum (and sometimes minimum) penalty for any offence. When deciding the appropriate sentence, the court must follow any relevant sentencing guidelines, unless it is not in the interests of justice to do so.

Sentencing for assault depends on the offence type.

Common assault:

the maximum sentence is six months’ custody
if the assault is against an emergency worker, the maximum sentence is one year’s custody
if the assault is racially or religiously aggravated, the maximum sentence is two years’ custody

Actual bodily harm:

the maximum sentence is five years’ custody
if the assault is racially or religiously aggravated, the maximum sentence is seven years’ custody

Grievous bodily harm or wounding:

the maximum sentence is five years’ custody.
if the assault is racially or religiously aggravated, the maximum sentence is seven years’ custody
if the assault was committed with intent to cause GBH/wounding then the maximum sentence is life imprisonment.

As I have read summaries sounds like they both went down the tunnel and both emerged the other side with no witnesses and no CCTV at the critical area. Under those circumstances looks likely he will get off with it or a lighter sentence when actually it looks like it's something more sinister? As said on here the jury can only deal in facts....

"alledged that", world of diference to "I observed" again it has to be facts/actual observation. Like or dis-like of the inividual immaterial?

Its an interesting one.  ABH is triable either way and it would be a brave move from Joey Barton to request a jury trial so my guess would be the magistrates sent it up to the crown court on the basis that they didn't think their own sentencing powers would be adequate if he was found guilty.
